Delivery Of Services

Subject to receipt of the applicable fees, GeneInsight Informatics Pvt Ltd (“GeneInsight“) shall perform the test(s) requested in this Test Requisition Form (“Test(s)”) in accordance with prevailing industry standards.

Reports

Test reports (“Report(s)”) will be issued within the Turn-Around-Time (“TAT”) specified in the Test Requisition Form. However, TAT may vary depending on the complexity of the requested Test(s), and GeneInsight shall not be held liable for any delays beyond the indicated timeframe.

Please note that the Report(s) generated are not intended to serve as a diagnosis, medical opinion, or treatment recommendation. GeneInsight strongly advises the Patient and/or their guardian(s) to consult a certified clinician or physician for interpretation of the Report(s). GeneInsight disclaims all liability arising from any use or interpretation of the Report(s).

Fees

The fees specified for the Test(s) (“Fees”) are exclusive of all applicable taxes and levies, which will be charged additionally in accordance with the law. The payment details, including the mode of payment and specifics of the Test(s) for which payment is being made, must be communicated to GeneInsight in advance, either by calling (+91)40 45329650 or by emailing reachus@geneinsight.ai

All payments must follow the ‘Payment Details’ outlined in the Test Requisition Form. GeneInsight will not be responsible for any fees unless payment is made as prescribed. To avoid any discrepancies, Patients or their guardians are advised to promptly confirm both the payment and Test(s) details via phone or email.

Roles & Responsibilities

By signing this Test Requisition Form, the Clinician affirms the accuracy of all information provided and confirms that they possess the necessary rights and consent to collect and submit the Patient’s sample for testing.

While GeneInsight may assist in the shipment of samples, it is not responsible for any damage that may occur during collection or transport to its laboratory. If a sample is inadequate or fails quality control (QC), GeneInsight may request a new sample. In the event that a replacement sample is not provided, GeneInsight reserves the right to deduct the costs incurred and refund the balance, if any.

The Clinician, Patient, and/or Patient’s guardians shall be jointly and severally liable to indemnify and hold GeneInsight harmless from any claim, liability, or loss arising out of or related to the requested Test(s) or these Terms and Conditions.

Term

These Terms and Conditions become effective upon signing of the Test Requisition Form and remain valid until the corresponding Report(s) are delivered.

Termination

If the requested Test(s) are cancelled for any reason, GeneInsight is not obligated to refund any fees paid in advance, except where a sample fails QC or is deemed inadequate for testing. In such cases, a partial refund may be issued after deducting any expenses already incurred.

Limitation Of Liability

In addition to the disclaimers stated elsewhere in this form, GeneInsight shall not be liable for any direct or indirect claims, losses, or damages incurred by the Clinician, Patient, Patient’s guardians, or any third party arising from reliance on the Report(s) or related to the Test(s) conducted under this Test Requisition Form.

Governing Law, Jurisdiction & Dispute Resolution

These Terms and Conditions and the Test Requisition Form shall be governed by the laws of India, with exclusive jurisdiction vested in the courts of Bangalore.

In the event of a dispute, the parties shall attempt to resolve the matter amicably within fifteen (15) days of notification. Failing resolution, the dispute shall be referred to arbitration before a sole arbitrator appointed by the President of the Arbitration Centre-Telangana, in accordance with the Arbitration and Conciliation Act, 1996, as amended. Arbitration shall take place in Hyderabad and be conducted in English. The arbitrator’s decision shall be final and binding.

Notice

All communications, including notices and statements, must be in writing and in English. Such correspondence may be delivered by hand, recorded post, or facsimile and should be directed to the address specified in the Test Requisition Form.

Independent Parties

GeneInsight and the other parties to this agreement operate as independent entities. Nothing in this document establishes an agency, employment, or joint venture relationship, and no party shall represent otherwise to any third party.
